1. Merchant Information

TruthDeck is operated by TruthDeck, India. Contact: legal@truthdeck.xyz. TruthDeck provides subscription-based SaaS services billed digitally through Cashfree Payments (India) and Stripe (international).

2. Acceptance of Terms

By accessing or using TruthDeck ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. TruthDeck ("we", "us", "our") operates this platform.

3. Description of Service

TruthDeck provides AI-powered startup research, algorithmic credibility scoring, and due diligence tools for informational and research purposes only. Nothing on TruthDeck constitutes financial, legal, investment, or professional advice of any kind. TruthScores, verdicts (VERIFIED, SUSPICIOUS, UNVERIFIED), and all related outputs are algorithmic estimates generated by automated systems from publicly available data. They are not statements of fact, not endorsements, and not guarantees of accuracy or completeness. You are solely responsible for any decisions you make based on information found on this platform.

4. Eligibility

You must be at least 18 years old and capable of entering a legally binding agreement. By using the Service, you represent that you meet these requirements.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at legal@truthdeck.xyz if you suspect unauthorized access.

6. Subscriptions and Payments

Paid plans are billed in advance on a monthly or annual basis. Indian users are billed in INR via Cashfree Payments. International users are billed in USD via Stripe. All prices are inclusive of applicable taxes unless stated otherwise.

7. Refund and Cancellation Policy

You may cancel your subscription at any time by emailing legal@truthdeck.xyz. Access continues until the end of the paid billing period. 7-Day Refund Guarantee: If you are not satisfied within 7 days of your initial purchase, email us for a full refund — no questions asked. After 7 days, refunds are at our discretion. Renewal charges are refundable within 48 hours of renewal. One-time report purchases are non-refundable once generated. This policy complies with the Consumer Protection Act, 2019 and applicable RBI guidelines.

8. Nature of Verdicts and Scores — Not Defamatory Statements

TruthDeck assigns algorithmic labels ("VERIFIED", "SUSPICIOUS", "UNVERIFIED") and numerical TruthScores to startups based solely on automated cross-referencing of publicly available data. These labels: (a) are not statements of fact about any company, founder, or individual; (b) do not constitute allegations of fraud, misconduct, illegality, or dishonesty; (c) reflect the degree to which publicly verifiable data corroborates or fails to corroborate publicly available claims — nothing more; (d) may be inaccurate, incomplete, or outdated; (e) are not prepared, reviewed, or endorsed by any licensed professional. The label "VERIFIED" does not constitute an official verification, certification, or endorsement by TruthDeck or any regulatory body. Startups or founders who believe their data is inaccurate may submit a dispute via the Dispute form on their profile page. We will review and, where appropriate, update data within a reasonable time.

9. Algorithmic Nature of Outputs and AI Limitations

TruthDeck uses large language models (LLMs) and automated data pipelines to generate scores, verdicts, summaries, investment memos, and other outputs. These are AI-generated and may contain errors, hallucinations, or outdated information. We make no representation that AI outputs are accurate, current, or fit for any particular purpose. Do not rely on AI-generated content without independent professional verification. TruthDeck expressly disclaims liability for any loss or damage arising from reliance on AI-generated content.

10. Intermediary Liability (IT Act Section 79)

TruthDeck operates as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. To the extent applicable, TruthDeck claims the safe harbour protection under Section 79 of the IT Act for third-party information and data displayed on the platform. TruthDeck does not initiate the transmission of data, does not select the recipients, and does not modify information beyond automated algorithmic processing of publicly available data. If you believe any content on TruthDeck infringes your legal rights, please contact our Grievance Officer at legal@truthdeck.xyz with details of the alleged violation. We will act on valid take-down requests within the timelines prescribed by applicable law.

11. Prohibited Use

You may not use TruthDeck to: (a) scrape, copy, or redistribute our data; (b) attempt to reverse-engineer our scoring models; (c) use the platform for any unlawful purpose; (d) impersonate any person or entity.

12. Intellectual Property

All content, scoring methodologies, UI, and data compilations on TruthDeck are owned by TruthDeck and protected by applicable intellectual property laws. You receive a limited, non-transferable license to use the Service for your own personal research. Startup names, logos, and trademarks displayed on TruthDeck remain the property of their respective owners and are used solely for identification purposes.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that TruthScores, verdicts, investment memos, or reports are accurate, complete, current, or reliable. We do not warrant that the platform will be error-free, uninterrupted, or free of harmful components. Investment decisions made based on TruthDeck data are solely your responsibility.

14. Indemnification

You agree to indemnify, defend, and hold harmless TruthDeck and its founders, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your reliance on any content or output from the Service for any financial or business decision; (d) any claim by a third party that your use of the Service violated their rights.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) TruthDeck, its founders, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of investment, loss of data, or loss of goodwill, arising from or in connection with your use of the Service, even if advised of the possibility of such damages; (b) TruthDeck shall not be liable for any investment or financial loss arising from reliance on TruthScores, verdicts, investment memos, or any other content on the platform; (c) TruthDeck shall not be liable for inaccuracies in startup data, including but not limited to errors in publicly available data that form the basis of our scores; (d) our total aggregate liability to you for all claims arising from or relating to the Service shall not exceed the greater of INR 1,000 (one thousand rupees) or the total amount you paid us in the 3 months immediately preceding the claim. This limitation reflects a reasonable allocation of risk between you and TruthDeck and is a fundamental element of the basis of the bargain between the parties.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. Before initiating any legal proceedings, you agree to first contact us at legal@truthdeck.xyz and attempt to resolve the dispute informally for a period of 30 days.

17. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify active subscribers of material changes by email.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
